Terms of Use.

These Terms govern access to and use of the SSG Management LLC website, screening platform, reports, training, communications, and related services. By accessing the services, creating an account, clicking an acceptance box, or submitting a screening, you agree to these Terms. If you use the services for an organization, you represent that you are authorized to act for that organization.

Purpose of the Services

SSG Management provides screening technology, automated scoring, workflow implementation, training, administrative support, and referral coordination. SSG Management is not a medical practice, school, emergency service, or health insurer. Unless a separate written agreement expressly states otherwise, SSG Management does not diagnose, prescribe, make treatment decisions, determine educational eligibility, or replace the professional judgment of licensed healthcare or educational personnel.

Accounts and Authorized Use

Users must provide accurate information, keep credentials confidential, and use only accounts and records they are authorized to access. An organization is responsible for identifying authorized users, promptly disabling access that is no longer appropriate, and using results in accordance with law, policy, professional standards, and its agreement with SSG Management.

Participant Responsibilities

Participants should answer screening questions honestly and completely to the best of their ability. A screening result may be incomplete or inaccurate when information is omitted, misunderstood, entered by another person, or affected by technical problems. Participants must seek help from a qualified professional for health, safety, educational, or clinical concerns and must use emergency services for urgent situations.

License and Intellectual Property

SSG Management grants authorized users a limited, nonexclusive, nontransferable, revocable license to use the services for their intended internal purpose during the authorized service period. SSG Management and its licensors retain all rights in the platform, software, scoring workflows, interface, designs, databases, compilations, reports, training materials, documentation, branding, and related intellectual property, except for content owned by a third party or an organizational client.

Prohibited Conduct and No Reverse Engineering

A user may not, directly or indirectly:

Copy, reproduce, republish, sell, sublicense, distribute, scrape, or commercially exploit the platform or its content except as expressly authorized in writing.

Reverse engineer, decompile, disassemble, decode, translate, discover source code or underlying structure, derive algorithms, create derivative technology, or attempt to recreate any portion of the platform, software, workflow, scoring logic, database structure, user interface, reports, integrations, or other technology.

Use automated tools, bots, crawlers, or extraction methods to access or collect platform data without written authorization.

Bypass access controls, test or scan for vulnerabilities without written authorization, interfere with system operation, introduce malicious code, or access another person's account or records.

Use the services for unlawful discrimination, harassment, fraud, surveillance, marketing based on screening responses, or any purpose inconsistent with a participant's consent.

Remove ownership notices or use SSG Management names, marks, or materials in a way that implies an unauthorized endorsement or partnership.

These restrictions apply to users, organizations, contractors, vendors, developers, competitors, and anyone acting on their behalf. They continue after access ends to the extent permitted by law.

Screening Content and Third Party Instruments

Some screening instruments, educational resources, or links may be owned or published by third parties and may be subject to separate terms, scoring requirements, licensing rules, and clinical instructions. SSG Management does not claim ownership of third-party instruments. Users must follow all use restrictions that apply to a selected instrument.

Clinical and Emergency Limitations

Screening results are informational tools and are not a diagnosis, treatment plan, medical order, or guarantee that a condition is present or absent. Automated scoring does not replace an assessment by an appropriately qualified professional. The services are not continuously monitored and are not designed for emergency response. In the United States, call 911 for an immediate emergency or call or text 988 for suicide or crisis support. Do not wait for an email, platform message, score, or referral response.

Communications

Users may receive service-related email, telephone, or text communications. Message and data rates may apply. Consent to receive marketing texts is not a condition of receiving screening services. A person may reply STOP to an automated text where supported, but may still receive communications required to provide a requested service or meet legal obligations through another permitted method.

Fees and Payment

Fees, payment timing, refunds, service levels, and renewal terms are stated at checkout or in the applicable organizational agreement. Users authorize approved charges and are responsible for applicable taxes and accurate billing information. SSG Management does not guarantee insurance coverage or reimbursement. Clinical billing decisions remain the responsibility of the billing healthcare provider.

Suspension and Termination

SSG Management may suspend or terminate access for nonpayment, unauthorized access, security risk, unlawful conduct, violation of these Terms, or as permitted by an organizational agreement. Upon termination, users must stop using protected platform materials. Data will be handled under the applicable agreement, retention requirements, and Privacy Policy.

Disclaimers

To the fullest extent permitted by law, the website and services are provided on an as available basis. SSG Management does not warrant uninterrupted operation, error-free results, the availability of a referral or provider, a particular clinical or educational outcome, insurance payment, or that every screening instrument is appropriate for every person or setting. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

Limitation of Liability

To the fullest extent permitted by law, SSG Management and its officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, goodwill, data, or business opportunity; or decisions made by a participant, organization, clinician, educator, or third party based on the services. Any limitation applies only to the extent enforceable and does not limit liability that applicable law prohibits limiting. An organization's signed agreement may contain different liability terms and will control for that organization.

Indemnification

To the extent permitted by law, an organizational user agrees to defend and indemnify SSG Management from third-party claims arising from that user's unauthorized or unlawful use, violation of these Terms, misuse of screening results, infringement of another person's rights, or failure to obtain required authority or consent. This section does not require indemnification for SSG Management's own conduct where prohibited by law, and a signed organizational agreement may replace this provision.

Governing Law and Disputes

Texas law governs these Terms without regard to conflict-of-law rules, except when federal law or another jurisdiction's mandatory law applies. Unless a signed organizational agreement states otherwise, the state and federal courts serving Van Zandt County, Texas, will have exclusive jurisdiction. Before filing a non-emergency claim, the parties should give written notice and make a good-faith effort to resolve the dispute.

Changes and Contact

We may revise these Terms prospectively. Continued use after revised Terms take effect constitutes acceptance when permitted by law. Questions may be sent to Sara@ssgwellness.com.
